Terms and Conditions

1 Introduction

Please read these Terms and Conditions ("T&C") carefully before making any purchases or transactions through ChallengersOnly or the www.challengersonly.gg website (the "Website/Service") or ("we")/("us") These T&C constitute a legally binding agreement between you and us.

Please note that these T&C apply to all purchases and transactions made through the Website/Service and should be read in conjunction with the Terms of Service www.challengersonly.gg/tos that govern the general use of the Website/Service.

2 Confirmation of Agreement

By making a purchase or transaction on the Website/Service, you acknowledge that you have read, understood, and agree to be bound by these T&C as well as the general Terms of Service listed on www.challengersonly.gg/tos. If you do not agree with these T&C or with the ToS, you may not make any purchases or transactions on the Website/Service.

4 Eligibility

By making a purchase or transaction from the Website/Service, you declare that you are:

• 4.1 of legal age in your jurisdiction or have parental/guardian consent to make purchases or transactions on the Website/Service.
• 4.2 neither a resident of South Korea nor physically present in South Korea at the time of purchase or transaction.

The Website/Service reserves the right to decline or cancel any orders or transactions from customers who are found to be minors, residents of South Korea or physically present in South Korea at the time of purchasing.

5 User Responsibilities

You agree to provide accurate and complete information for your purchases or transactions. The Website/Service is not responsible for any errors or delays caused by inaccurate information provided by you.

By placing an order or initiating a transaction on the Website/Service, you:

• 5.1 are making an offer to purchase the specified service, subject to these T&C.
• 5.2 declare that the prices, features and specifications of your order have not been created, manipulated or altered through misuse, abuse, or unintended use of our systems, models, programming, servers and website, including, but not limited to "parameter manipulation" also known as "parameter tampering", data manipulation, tampering or hacking.

6 Pricing

The prices for services displayed on the Website/Service are subject to change without notice.

7 Cancellations

We reserve the right to cancel an order if we determine that we are unable to fulfill it.

8 Refunds

All fees paid for services that have already been rendered are non-refundable. Furthermore, additional refund policies are in effect and can be found in Section 17 and Section 18 of this agreement.

9 Modifications to the Terms and Conditions

The Website/Service reserves the right to modify or update these T&C at any time without prior notice. It is your responsibility to review these T&C periodically for any changes. Continued use of the Website/Service after any modifications constitutes your acceptance of the updated T&C. You may find the latest version of these Terms and Conditions at www.challengersonly.gg/tc.

10 Breach and Consequences

If you are found to have breached the T&C or ToS at any time, the Website/Service has the right to cancel your orders and refuse your future patronship indefinitely.

11 Liability

The Website/Service shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising from your use of the Website/Service or any issues related to your purchases or transactions, except in cases of gross negligence or intentional misconduct. Additional liability clauses may apply.

By purchasing from the Website/Service, you agree that you understand the inherent risk of this service.

12 Governing Law

These Terms shall be governed by and construed in accordance with the laws of Hungary. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Hungary.

13 Dispute Resolution

If a dispute is ongoing, the Website/Service reserves the right to cancel or temporarily suspend all of your orders.

14 Severability

If any provision of these T&C is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

16 Uniform Application of Terms and Conditions

All terms, conditions, provisions, statements, and information stated in the preceding sections apply uniformly to the entirety of this document, including all subsequent sections and "service specific terms and conditions", unless expressly specified otherwise.

17 Service Specific Terms and Conditions:

In the event a service provided by us is not listed in this document, we have the right to determine which clauses are applicable.

If the service is listed under section 18 specific services, the following sections apply only when referred to:

17.1 Cancellation Rights and Abuse Policy

We or our affiliated "booster" or "coach" has the right to cancel the service at any time at his discretion if the booster or coach is abused by you or your (online) friends, family or acquaintances, while providing our services. Examples of abuse include, but are not limited to: harassment, discrimination, exploitation.

All orders cancelled for these reasons are non-refundable.

17.2 Limitation of Booster/Coach Liability

You shall not hold the booster or coach responsible for any damages with regards to any of your purchases or transactions with the Website/Service.

17.3 Additional Liability Clause:

You acknowledge and agree that the Website/Service shall not be held responsible for any actions resulting in the suspension, banning or penalization of your account. This includes, but is not limited to any services provided by us that we deem necessary to fulfill your order.

Two examples of such services could be:

• A long boost with unorthodox champion and role combinations, per your specifications, such as "Yuumi" and "jungle", resulting in the account accrueing a significant number of "reports".
• A boost that requires "win-trading" to complete, including but not limited to the aforementioned unorthodox specifications requested and/or boosting of accounts ranked within the top 5% of rankings per the official League of Legends ranking ladder.

Please note that these examples are provided for informational purposes and are not meant to be a complete, exhaustive list or overview of such scenarios.

you acknowledge and agree that the Website/Service shall not be held responsible for suspension, banning or penalization of your account, as the result of your actions, including but not limited to logging in while the service is ongoing or disclosing your purchase of our services to anyone.

By purchasing from the Website/Service, you agree that you understand the inherent risk of this service.

17.4 Frequent Occurence Refund Policy

"Frequent occurrence" shall be defined as no less than twice annually per customer. No refunds, full or partial, shall be provided to frequent occurences of refund requests. In situations where we are obligated by law to provide a refund nonetheless, we reserve the right to charge administrative and processing fees, which we do not charge for infrequent refunds requests (less than twice annually per customer).

17.5 Partial Refund Policy

"Progress" in 17.5 and 17.6 shall be defined as the games played by the booster or those currently in progress on your League of Legends account, from the time we have fully processed your cancellation or refund request (within reason), including notifying our booster and not from the moment your cancellation was sent or received. If applicable, "progress" will also encompasses coaching sessions already completed or in progress.

We shall substract the equivalent cost of progress made from the refund amount. You may request our methodology for determining this amount.

17.6 No Refund Policy

No refunds are possible for these services, with the exception of services where zero progress* was made.

*Progress as defined in 17.5

17.7 Scheduled Services Policies

In the event that our services have been scheduled to be provided at a specific time, the following conditions regarding rescheduling, refunds and cancellations apply:

17.7.1 Refunds and Cancellation

17.7.1.1 Full refunds will be issued if a cancellation or refund request is submitted with at least 24 hours' notice prior to the scheduled service.

17.7.1.2 For cancellation or refund requests submitted between 12 to 24 hours prior to the scheduled service, partial refunds may be issued, although we are not obligated to do so.

17.7.1.3 No refunds will be issued for cancellation or refund requests made within 12 hours of the scheduled service.

17.7.2 Rescheduling

Rescheduling requests must be submitted with at least 24 hour's notice prior to the scheduled service and only one rescheduling request is permitted per purchase.

If rescheduling requests are more frequent, we reserve the right to charge extra fees or provide reduced or no services.

17.7.3 Non refundability of Ongoing Services

Services in progress are never refundable

*An additional rescheduling opportunity is provided free of charge and with no penalty for every four coaching sessions purchased.

The requirement to not be in Korea at the time of purchase, or not be a resident of Korea, as described under section 4.2 Eligibility, does not apply, solely with regards to the "coaching" service.

18.4.2 Challenger Coaching Giveaway

By participating in the coaching session, you acknowledge and agree that the recording of the session is the exclusive property of the Website/Service also known as ChallengersOnly and ChallengersOnly.gg. Furthermore, by participating, you hereby waive any rights or claims to the recording, including but not limited to any rights of privacy or publicity. Additionally, you grant the Website/Service, ie ChallengersOnly and Challengersonly.gg permission to use your voice, likeness, and any information disclosed during the recording for promotional, educational, or other purposes related to the coaching session, including but not limited to displaying the coaching session on our website and uploading it to video hosting platforms for public viewing.

18.5 Accounts

You agree that:

• Any accounts used in our transactions are technically not in either parties possession, but the property of Riot Games inc.
• You interpret any account purchased from us as a non-durable service, in which we grant you access to the account
• Accounts services that are not named explicitly in the ToC be part of a replacement policy are non-replaceable
• Accounts services that are not named explicitly in the ToC be part of a refund policy are non-refundable

18.5.1 Replacement and Refund Policy

Unique one-of-a-kind accounts are refundable under the following conditions and all other accounts are replaceable under the following conditions:

• the account was not delivered as per the specifications and-
• this was reported to the Website/Service through support@challengersonly.gg within 72 hours of delivery.
• control of the account is transfered back to the Website/Service.
• the account remains unaltered in any significant manner, as determined by us.

Specific conditions for non-alteration include, but are not limited to:

• The password was not changed
• No other information was added to or tied to the account, including but not limited to phone numbers, email adresses and other Riot or League of Legends accounts
• The account was not verified if it was delivered as an unverified account
• No game lobbies, also known as "champion selections" were entered
• No games were played using the account, including all game modes
• No in-game currencies, including but not limited to Riot Points, Blue Essence, Orange Essence, or Gemstones were spent
• No in-game items were crafted
• No lootboxes, orbs, chests or other in-game content were opened
• No in-game content was redeemed or refunded
• No chat system, voice-chat system, friends-list system, reporting system, or other built-in feedback system, was utilized through the account or linked accounts
• No communication with Riot, League of Legends, their employees or systems, including their ticket system, took place through the account or linked accounts
• No communication with Riot, League of Legends, their employees or systems, including their ticket system, by you or others, took place regarding the account
• No disclosure, privately or publicly, by you or others, of your ownership or purchase of this account took place

If we determine that your handling of the account while under your control does not comply with these conditions or their spirit, we reserve the right to deny any applicable refunds or replacements. In such instances, we may, at our discretion, offer a partial refund or replacement, although we are not obligated to do so.

Please note that the above specific conditions for non-alteration are subject to our assessment and may vary on a case-by-case basis.

This concludes the end of the document. Note that sections 1 through 16, inclusive, apply to the entirety of this agreement, unless stated otherwise.
